Vitality Suites™ Terms of Use

Last updated: October 9, 2026

These Terms of Use ("Terms") govern your access to and use of the Vitality Suites™ website at https://vitalitysuites.com, including its content, suite planner, inquiry forms, and related online features (collectively, the "Website"). Vitality Suites™ is a brand operated by Performance Lifestyle Inc. ("we," "us," or "our").

Please read these Terms before using the Website. By using the Website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please discontinue use. Purchases and project services are also subject to the separate agreements described below.

  1. 01

    Our services

Vitality Suites helps clients plan, specify, source, and coordinate personalized recovery and wellness environments for residential and commercial properties. Depending on the agreed project, services may include equipment recommendations, space planning, equipment supply, delivery and installation coordination, ownership orientation, and guidance for use.

The services included in your project are defined in your accepted proposal or written agreement. Website descriptions do not mean that every service, technology, or feature is included in every suite.

  2. 02

    Eligibility and responsible use

You must be at least 18 years old to submit a project inquiry, create an account, or enter into a purchase or service agreement through the Website. If you act for a business or another person, you must have authority to do so.

You agree to provide accurate information and use the Website lawfully. You must not attempt unauthorized access, interfere with security or functionality, distribute malicious software, impersonate another person, or use the Website to infringe the rights of others.

  3. 03

    Planning tools and preliminary recommendations

Suite planner results, website recommendations, and initial discussions are preliminary. Final recommendations depend on your goals, budget, space, equipment specifications, site conditions, and the agreed project scope.

Submitting an inquiry or completing a planner does not create a purchase obligation, reserve equipment, establish a final price, or guarantee project acceptance.

  4. 04

    Proposals, purchases, and project agreements

Equipment purchases and project services are governed by the applicable accepted proposal, order terms, installation agreement, warranty, or other written agreement provided for that transaction.

Those documents specify matters such as pricing, taxes, deposits, payment schedules, delivery, installation responsibilities, changes, cancellations, returns, and support. If these Terms conflict with an accepted transaction-specific agreement, that agreement controls for the transaction, subject to applicable law.

These Website Terms do not establish a blanket nonrefundable-deposit policy, cancellation fee, or return restriction.

  5. 05

    Pricing, availability, and timelines

Website prices, examples, specifications, and availability may change. Images may show optional equipment, furnishings, finishes, or services that are not included in a quoted package. We aim to provide accurate information and will address identified errors before confirming an order. Accepted orders remain subject to their agreed terms and applicable law.

Project estimates and delivery timelines depend on factors such as manufacturer availability, shipping, site readiness, and scheduling. Any binding deadlines or commitments must be stated in your project agreement.

  6. 06

    Site requirements and installation

Equipment may require specific electrical capacity, ventilation, drainage, floor support, access clearances, or other site conditions. Your project agreement identifies the responsibilities assigned to us, you, and any outside professionals.

Unless expressly included in the agreed scope, our planning and coordination services do not include licensed architectural or engineering services, structural assessments, permitting, electrical work, plumbing, or construction. Work requiring a licensed professional must be performed by an appropriately qualified provider.

  7. 07

    Wellness information and equipment use

Website content and general equipment-use guidance are provided for educational and wellness purposes. They are not medical advice, diagnosis, or treatment and do not replace care from a qualified healthcare professional.

Suitability depends on the technology and the individual. Follow the manufacturer's operating instructions, safety requirements, and contraindications. Consult an appropriate healthcare professional when needed, including when you have a medical condition or concerns about using a particular technology.

We do not guarantee a particular health, energy, recovery, performance, weight-loss, or other personal outcome. Testimonials and examples reflect individual experiences and do not promise the same results for every user.

  8. 08

    Product warranties and support

Product warranties vary by manufacturer, model, and intended use. Review the applicable warranty before purchasing, including coverage, exclusions, commercial-use restrictions, and service procedures.

Any warranty or support commitment made by Performance Lifestyle Inc. is governed by the applicable written warranty or transaction agreement and by law. The Website disclaimers below do not cancel product warranties, agreed service obligations, or consumer rights that cannot lawfully be waived.

  9. 09

    Intellectual property

Website text, graphics, designs, educational materials, trademarks, logos, and other content are owned by Performance Lifestyle Inc., its licensors, or the relevant third-party rights holders. These Terms do not transfer ownership of intellectual property to you.

You may view the Website and retain copies of materials made available for your personal evaluation or expressly permitted use. You may not reproduce, republish, sell, or commercially exploit protected content without permission, except as permitted by law. Product and brand names belonging to other companies remain their property.

  10. 10

    Information and materials you provide

You are responsible for ensuring you have permission to provide photographs, floor plans, project documents, and other submitted materials. You authorize us to use and share those materials as reasonably necessary to evaluate your inquiry and perform services you request, subject to our Privacy Policy and applicable agreements.

You retain ownership of your materials. This permission does not authorize us to use identifiable project photographs, testimonials, or your personal story in public marketing without your separate permission. Avoid submitting unrelated sensitive information through general inquiry forms.

  11. 11

    Third-party services and links

The Website may link to or use services supplied by independent manufacturers, financing providers, scheduling platforms, payment processors, and other organizations. Their own terms and privacy policies may apply when you interact with them.

We do not control independent third-party websites or guarantee their content or availability. This section does not excuse responsibilities we have expressly undertaken in your agreement or responsibilities imposed on us by law. Financing approval and terms are determined by the financing provider.

  12. 12

    Accounts

If an account feature is offered, keep your registration information accurate and your credentials secure. Do not share or misuse credentials. Notify us promptly if you suspect unauthorized account access. Your responsibility for account activity is subject to applicable law and does not make you automatically liable for every unauthorized action.

  13. 13

    Privacy and communications

Our Privacy Policy explains how we handle personal information. Submitting an inquiry allows us to respond and coordinate your request; it does not by itself authorize every form of promotional communication. Marketing communications remain subject to applicable consent requirements and your preferences.

  14. 14

    Website availability and disclaimers

We may update, interrupt, or discontinue Website features. We do not promise uninterrupted access or that all Website content will be free from errors.

To the extent permitted by applicable law, the Website and its general informational content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or noninfringement. This disclaimer applies to the Website and general informational content, not to purchased equipment warranties or contracted services.

Nothing in these Terms excludes or limits liability, remedies, or rights that cannot be excluded or limited under applicable law, including applicable consumer protection and warranty rights. These Terms do not impose a general waiver of claims for personal injury, fraud, gross negligence, or willful misconduct.

  15. 15

    Suspension or termination

We may restrict or suspend Website or account access where reasonably necessary to address misuse, security risks, unlawful activity, or violations of these Terms. Where practicable, we will provide notice.

You may stop using the Website at any time. Discontinuing Website use or suspending an account does not automatically cancel an existing order, project agreement, warranty, or payment obligation. Provisions that by their nature continue after Website use ends remain applicable, subject to law.

  16. 16

    Governing law and disputes

These Terms are governed by the laws of New Jersey, without regard to conflict-of-law rules, except where applicable law requires otherwise. Subject to any nonwaivable rights concerning jurisdiction or venue, disputes relating to these Website Terms will be heard in state or federal courts with appropriate jurisdiction in New Jersey.

A separate transaction agreement may specify terms governing disputes relating to that transaction. These Website Terms do not impose mandatory arbitration or a waiver of class actions or jury trials.

  17. 17

    Changes to these Terms

We may update these Terms and will post the revised version with an updated date. For material changes, we will provide reasonable advance notice through the Website or another appropriate method, except where an immediate change is necessary for legal or security reasons.

Changes apply prospectively and do not retroactively alter accepted project agreements or accrued rights. Where additional assent is legally required, we will obtain it. If you do not agree to revised Terms, discontinue Website use.
